These Terms of Service (the “Terms”) govern your access to and use of the Career Bridge platform at careerbridge.mascansw.com.au (the “Platform”). The Platform is operated by the Malaysian Students Council of Australia, NSW Chapter (“MASCA NSW”, “we”, “us”, “our”).
Please read these Terms carefully. Together with our Privacy Policy, they form the agreement between you and MASCA NSW.
1. Acceptance of terms
By creating an account, signing in, or otherwise using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not create an account and do not use the Platform.
If you are using the Platform on behalf of an organisation (for example, as a partner uploading opportunities), you confirm that you are authorised to bind that organisation, and references to “you” include both you and that organisation.
2. Eligibility
You may use the Platform if all of the following are true:
- You are at least 16 years old. If you are between 16 and 18, we recommend that a parent or guardian help you understand these Terms.
- You are a Malaysian student, a student of Malaysian heritage, or a friend of MASCA who is studying or has recently studied at an Australian tertiary institution. The Platform is designed for this community, although we do not block other users from creating accounts.
- You have not been previously suspended or banned from the Platform.
- You provide accurate information when you sign up and keep it updated.
We may refuse, suspend, or terminate accounts that do not meet these criteria.
3. Your account
3.1 One account per person
Each person may hold only one account. Do not create multiple accounts to evade restrictions, manipulate features, or impersonate others.
3.2 Sharing and credentials
You are responsible for keeping your sign-in credentials safe. Do not share your password or sign-in tokens with anyone. If you sign in via Google OAuth, keep your Google account secure.
3.3 Activity from your account
You are responsible for everything that happens under your account, except where unauthorised access has occurred despite you taking reasonable steps to keep your credentials secure. If you suspect unauthorised access, notify us immediately at educare@nsw.masca.org.au.
3.4 Accurate information
Provide accurate, current, and complete information. Update your profile when material details change (for example, when you graduate or change universities).
4. Acceptable use
4.1 Things you must not do
You must not use the Platform to:
- Scrape, copy, or systematically extract data without our written permission. This includes automated requests, headless browsers, and bulk downloads.
- Reverse engineer, disassemble, or attempt to derive source code from the Platform, except where this is permitted by mandatory law.
- Probe, scan, or test the vulnerability of the Platform, or attempt to bypass authentication or security controls.
- Harass, threaten, intimidate, dox, or stalk any other user, partner, or staff member.
- Discriminate against, harass, or vilify any person on the basis of race, religion, gender, sexuality, disability, or other protected attribute.
- Impersonate another person, organisation, or representative of MASCA NSW.
- Submit false, misleading, or deceptive information, including fake job applications or false reports.
- Use the Platform to send spam, chain messages, commercial solicitations, multi-level marketing pitches, or political campaigning.
- Upload viruses, malware, or any code intended to disrupt the Platform.
- Infringe anyone else’s intellectual property, privacy, or other legal rights.
- Use the Platform in a way that breaches Australian law, the law of your home jurisdiction, or any other applicable law.
4.2 Reporting misuse
If you encounter behaviour that breaches section 4.1, report it to us at educare@nsw.masca.org.au. We will review reports and take action where appropriate.
5. Content and intellectual property
5.1 Platform content
The Platform itself, including its design, code, brand, name, logos, layout, and the curation of opportunities, is owned by MASCA NSW or its licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes consistent with these Terms.
You may not copy, modify, distribute, sell, or commercially exploit any part of the Platform, except where mandatory law allows it.
5.2 Your content
When you submit content to the Platform (for example, a profile bio, a comment, or an uploaded resume), you keep ownership of that content.
By submitting content, you grant MASCA NSW a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, display, and process that content for the purpose of operating the Platform and providing you with the service. This licence ends when you delete the content or your account, except for backup copies that may persist for a short period as described in our Privacy Policy.
5.3 Aggregate insights
You agree that we may produce anonymised, aggregated insights from how the Platform is used. These insights cannot identify you. We may share these insights with our exec council, partners, and the wider community.
5.4 Feedback
If you send us feedback, suggestions, or feature requests, we may use them without obligation or compensation to you. You will not be paid for ideas you contribute, although we may credit you publicly with your consent.
6. Job listings and opportunities
This section is important. Please read carefully.
6.1 We are not the employer
MASCA NSW is notthe employer for any job, internship, or opportunity listed on the Platform. We aggregate listings from third-party sources (such as Adzuna, Himalayas, Microsoft Learn, and partner organisations) and curate selected opportunities from our exec team’s outreach.
6.2 No employment guarantee
A listing on the Platform is not a guarantee that:
- The role is currently open.
- The advertised pay, hours, conditions, or location are accurate.
- The employer is reputable, solvent, or compliant with Australian workplace law.
- You will be hired, interviewed, or shortlisted.
- The role is suitable for your visa, course, or work eligibility.
6.3 Your responsibility
You are responsible for:
- Verifying job details directly with the employer before applying.
- Confirming that you are eligible to work in the relevant role under your visa, study agreement, and Australian workplace law.
- Reading the employer’s privacy policy before submitting your application to them.
- Avoiding scams. We try to filter listings, but bad actors sometimes slip through. Never pay money to apply for a job, never share your tax file number or bank details before signing a legitimate offer, and never accept a role without a written agreement.
6.4 Reporting bad listings
If you find a listing that is misleading, expired, fraudulent, or inappropriate, report it to us at educare@nsw.masca.org.au. We will review and remove confirmed problems.
7. Third-party links and services
The Platform contains links to third-party sites and services (employers, universities, service providers, news outlets). We do not control these sites and are not responsible for their content, practices, or terms.
When you leave the Platform via a third-party link, you do so at your own risk and you are subject to that site’s terms and privacy practices.
8. Suspension and termination
8.1 Termination by you
You can delete your account at any time from your settings, or by emailing us. After deletion, your information is handled as described in our Privacy Policy.
8.2 Suspension or termination by us
We may suspend or terminate your access if, in our reasonable opinion:
- You have breached these Terms.
- You have placed the Platform, other users, or MASCA NSW at legal, security, or reputational risk.
- We are required to do so by law.
- The Platform is being shut down (we will provide reasonable notice where possible).
Where the breach is minor and capable of being cured, we will usually warn you before terminating.
8.3 Effect of termination
Upon termination:
- Your right to use the Platform ends immediately.
- Sections that by their nature should survive termination (intellectual property, disclaimers, liability, indemnity, governing law, dispute resolution) continue to apply.
9. Disclaimer of warranties
To the maximum extent permitted by law, the Platform is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not guarantee that:
- The Platform will be uninterrupted, error-free, or secure at all times.
- Defects will be corrected within a particular time.
- The Platform is free from viruses or harmful code.
- The information on the Platform (including job listings, partner profiles, event details) is accurate, complete, or up-to-date.
Career Bridge is operated by volunteers as a community service. We work hard to keep it useful, but we cannot guarantee a commercial-grade service level.
9.1 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law where to do so would be unlawful. Where the Australian Consumer Law applies and our liability for a breach of a consumer guarantee can lawfully be limited, our liability is limited (at our option) to:
- Re-supplying the relevant service, or
- Paying the cost of having the relevant service re-supplied.
10. Limitation of liability
Subject to section 9.1, to the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, or punitive loss or damage arising out of or in connection with your use of the Platform. This includes lost opportunities, lost profits, lost wages, lost data, or reputational damage.
- Our total aggregate liability to you in any 12-month period for any and all claims arising out of or relating to the Platform is limited to AUD 100, or the amount we are required to pay under the Australian Consumer Law where that amount is higher and cannot be excluded.
- We are not liable for any loss or damage caused by:
- Inaccurate or fraudulent listings posted by employers or third parties.
- The conduct of other users.
- The decision of any employer not to hire, interview, or pay you.
- Service outages, downtime, or data loss caused by our service providers.
You acknowledge that Career Bridge is a free, volunteer-operated community service, and that the limitations in this section reflect that nature.
11. Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold harmless MASCA NSW, its committee members, EduCare team, volunteers, and partners against any claim, loss, damage, cost, or expense (including reasonable legal costs) that arises from:
- Your breach of these Terms.
- Your misuse of the Platform.
- Content you submit to the Platform that infringes someone else’s rights or breaches the law.
- Your interactions with employers or other users that occur outside the Platform.
This indemnity does not apply to the extent that the loss is caused by our negligence, our wilful misconduct, or a matter that cannot lawfully be the subject of an indemnity.
12. Privacy
Your privacy is important to us. The Privacy Policy at careerbridge.mascansw.com.au/privacy-policy describes what we collect, how we use it, and your rights.
In particular, please note that Career Bridge data does not flow to NexArah Sdn. Bhd., despite the EduCare Director also being the founder of NexArah. See section 7 of the Privacy Policy for the full explanation.
By using the Platform, you confirm that you have read and understood the Privacy Policy.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia, and the federal laws of the Commonwealth of Australia that apply in NSW.
14. Dispute resolution
We want to resolve disputes quickly and amicably.
14.1 Direct discussion first
Before starting any formal proceedings, you agree to:
- Notify us in writing of the dispute, with enough detail for us to understand it.
- Give us 30 days to respond and try to resolve the matter in good faith.
14.2 Mediation
If we cannot resolve the dispute through direct discussion, both parties agree to attempt mediation through the Resolution Institute (resolution.institute) or a similar Australian mediation body, before commencing court proceedings. Each party bears its own mediation costs unless we agree otherwise in writing.
14.3 Court proceedings
If mediation fails, the courts of New South Wales (and any courts that hear appeals from them) have exclusive jurisdiction over any dispute arising out of or relating to these Terms.
14.4 Urgent injunctive relief
Nothing in this section prevents either party from seeking urgent injunctive or equivalent relief in a court of competent jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes:
- We will update the “Last updated” date at the top.
- We will post a notice in the platform’s announcement banner for at least 14 days.
- We will email registered users for significant changes.
Continued use of the Platform after the new Terms take effect means you accept the changes. If you do not accept the changes, please stop using the Platform and delete your account.
16. General
16.1 Entire agreement
These Terms, together with the Privacy Policy and any specific written agreement we sign with you (for example, a partnership agreement), are the entire agreement between you and MASCA NSW about the Platform.
16.2 Severability
If any part of these Terms is held to be invalid or unenforceable, the rest remains in force.
16.3 No waiver
If we do not enforce a right under these Terms, that does not mean we have waived it.
16.4 Assignment
You may not transfer your account or rights under these Terms to anyone else. We may transfer our rights and obligations to a successor entity (for example, if MASCA NSW restructures or merges with another association), provided your rights are not materially reduced.
16.5 No partnership
These Terms do not create a partnership, employment relationship, agency, or joint venture between you and MASCA NSW.
16.6 Force majeure
Neither party is liable for delays or failures caused by events beyond its reasonable control, including natural disasters, pandemics, government restrictions, internet outages, or service provider failures.
